FAA Fines Several Aviation Companies, Including Boise Firm

In July of 2011, the Federal Aviation Administration (FAA) proposed civil penalties against eight different aviation companies for a wide range of regulatory infractions. For those injured in an airplane crash or another type of aviation accident, FAA sanctions could help shore up accusations of unsafe operations.

Fines of Up to $133,950 for Violations

The steepest proposed fine of $133,950 is against JetSmart, Inc. The company allegedly flew a potentially unsafe business jet on some 60 flights. The jet was not in compliance with FAA rules requiring that onboard fire extinguishers be inspected monthly.

Another failure to follow FAA rules contributed to a plane crash in July of 2010. Apollo Aviation is accused of neglecting to perform mandatory inspections of the altimeter, static system and transponder on a Cessna 172 in their fleet during the two years prior to the plane accident. Apollo Aviation may have to pay $77,300.

Boise's very own Aviation Specialties Unlimited, Inc., was penalized for allegedly incorrectly installing a night vision system in a helicopter based on unreliable technical information. This improper aircraft modification pertained to an aircraft used for emergency medical services. The potential for harm caused by negligently installed equipment could have been quite high, leaving potential victims with no recourse but to speak to an aviation accident attorney in Boise. The proposed fine against Aviation Specialties Unlimited, Inc. totaled $77,000.

Each company has the opportunity to challenge the FAA's proposed civil penalties; whatever the eventual outcome, the sanctions could have ongoing implications for the affected aviation firms.

Civil Fines May Impact Personal Injury Suits

Failure to follow an FAA regulation is not definitive proof of negligence in a personal injury or wrongful death lawsuit. However, the fact that an aircraft company has been cited for jeopardizing safety in connection to FAA rule violations can carry substantial evidentiary weight. Ultimately, an assessment of FAA civil penalties could tip the scale against negligent aviation companies in private legal proceedings.
